Terms of Service

1. Agreement to Terms

By accessing or using Hireflow ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms apply to all users, including visitors, registered users, and subscribers.

2. Description of Service

Hireflow is an AI-powered resume tailoring service that helps job seekers create customized resumes and cover letters for specific job applications. The Service includes:

  • Resume parsing and storage
  • AI-powered resume tailoring based on job descriptions
  • Cover letter generation
  • Application tracking and analytics
  • Document export in PDF and DOCX formats

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access to your account
  • Be responsible for all activities that occur under your account

3.2 Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Pricing and Payments

4.1 Free Tier

New users can create an account and use Hireflow for free with the following limitations:

  • 3 AI-tailored resumes total (lifetime limit)
  • 2 basic resume templates
  • First-page-only downloads (PDF and DOCX) - full download if resume is 1 page

No credit card required. You can use the free tier indefinitely within these limits.

4.2 Job Search Pass

The Job Search Pass is a one-time payment that provides full access to all Service features for 90 days. There is no subscription and no automatic renewal. Pricing is as follows:

  • Standard Price: $49 for 90 days of full access
  • Early Access Price: $29 for the first 1,000 users (limited availability)
  • Reactivation Price: $29 for returning users who have previously purchased a Job Search Pass

The Job Search Pass includes:

  • Unlimited AI-tailored resumes for 90 days
  • All 12 premium templates
  • Unlimited PDF and DOCX exports
  • Complete ATS analysis and optimization
  • Cover letter generation
  • Interview prep guides
  • Application tracking

4.3 Pass Expiration and Read-Only Mode

When your Job Search Pass expires after 90 days:

  • You will not be charged again (there is no automatic renewal)
  • Your account will enter "Read-Only Mode"
  • You can view all saved applications and resumes forever
  • You cannot create new tailored resumes, generate cover letters, or download documents
  • You can purchase a new Job Search Pass at the reactivation price ($29) to regain full access
  • You can export your data at any time

4.4 Billing and Payment

By purchasing a Job Search Pass, you agree to:

  • Pay the one-time fee at the time of purchase
  • Provide valid payment information
  • Pay any applicable taxes

Payment is processed securely through third-party payment processors (such as Stripe). Your 90-day access period begins immediately upon successful payment.

Pricing and taxes: Prices are displayed at checkout in your selected currency (or local currency where supported). Taxes may be added where required by law and will be shown before you complete your purchase.

Merchant of record: Hireflow (individual operator in New Zealand) is the merchant of record unless stated otherwise at checkout.

4.5 Price Changes

We may change prices for the Job Search Pass at any time. Price changes will not affect any Job Search Pass you have already purchased. Early access pricing is available for a limited time and may be discontinued without notice once the early access quota is reached.

5. Refund Policy

We offer a 14-day money-back guarantee for your first Job Search Pass purchase. If you are not satisfied with Hireflow, you may request a full refund within 14 days of your purchase. After 14 days, no refunds will be issued, but you will retain access to the Service until your 90-day pass expires.

Refunds are limited to one per customer (including across multiple accounts or payment methods). We may deny refund requests that appear abusive, fraudulent, or in bad faith, consistent with our Refund Policy and applicable law.

6. Digital Services and EU/UK Withdrawal Rights

By purchasing the Job Search Pass, you request immediate access to the Service and acknowledge that digital services will begin right away. If you are in the EU or UK, this may affect your statutory right to withdraw once the Service has been fully performed. Where required by law, we will obtain your explicit consent at checkout.

7. No Subscription to Cancel

The Job Search Pass is a one-time purchase, not a subscription. There is no automatic renewal and nothing to cancel. Your access simply expires after 90 days.

  • You will never be charged automatically
  • Your 90-day access period begins at purchase and cannot be paused
  • After your pass expires, your account enters Read-Only Mode (see Section 4.3)
  • Your account and data will be preserved unless you request deletion
  • You can purchase a new Job Search Pass at any time to regain full access

Free tier users: If you are using the free tier (3 resumes), there is nothing to cancel. You can continue using the free tier or upgrade to a Job Search Pass at any time.

8. User Content and Ownership

7.1 Your Content

You retain all ownership rights to the content you upload to the Service, including your resume, job descriptions, and any other information ("User Content"). By using the Service, you grant us a limited license to:

  • Store and process your User Content
  • Use AI to generate tailored resumes and cover letters
  • Display your User Content within your account

We will never sell or share your User Content with third parties for marketing purposes.

7.2 Generated Content

Content generated by our AI (tailored resumes, cover letters) is owned by you. You have full rights to use, modify, distribute, and otherwise exploit the output for any lawful purpose. Hireflow retains no ownership interest in AI-generated content created for your account.

7.3 Content Restrictions

You agree not to upload content that:

  • Infringes on intellectual property rights
  • Contains false or misleading information
  • Violates any applicable law or regulation
  • Contains malicious code or viruses

7.4 Responsibility for Your Content

You are solely responsible for the content you upload, generate, and distribute using the Service, including tailored resumes and cover letters. This means:

  • You are responsible for reviewing, verifying, and approving all content before you use or share it
  • You are responsible for how and where you distribute your resumes and cover letters
  • You represent that you have all necessary rights to use and share your content
  • You agree that you, not Hireflow, are liable for any claims arising from your content or its distribution

9. Acceptable Use

You agree to use the Service only for lawful purposes. You may not:

  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Interfere with or disrupt the Service or servers
  • Use automated means (bots, scrapers) to access the Service without permission
  • Reverse engineer, decompile, or attempt to extract source code
  • Resell or redistribute the Service without authorization
  • Use the Service to create resumes with false or fraudulent information
  • Violate any applicable laws or regulations

10. AI-Generated Content Disclaimer

Our Service uses artificial intelligence to generate tailored resumes and cover letters. While we strive for accuracy and quality:

  • AI-generated content may contain errors or inaccuracies
  • You are responsible for reviewing and verifying all generated content before use
  • We do not guarantee that tailored resumes will result in job interviews or offers
  • The Service is a tool to assist you, not a replacement for your judgment

You are solely responsible for the accuracy and truthfulness of information in your final resume.

11. Intellectual Property

The Service, including all content, features, and functionality (excluding User Content and AI-generated content as described in Section 8.2), is owned by Hireflow and is protected by copyright, trademark, and other intellectual property laws. You may not:

  • Copy, modify, or create derivative works of the Service
  • Use our trademarks or branding without permission
  • Remove or alter any proprietary notices

12. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.

13. Disclaimers and Warranties

12.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12.2 No Guarantee of Results

We do not guarantee that:

  • The Service will meet your specific requirements
  • The Service will be uninterrupted, timely, secure, or error-free
  • AI-generated content will be accurate or complete
  • Using the Service will result in job interviews or employment

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIREFLOW SHALL NOT BE LIABLE FOR:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, REVENUE, DATA, OR USE
  • DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE
  • DAMAGES ARISING FROM ERRORS OR INACCURACIES IN AI-GENERATED CONTENT

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

15. Indemnification

You agree to indemnify and hold harmless Hireflow, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • False or misleading information in your resumes

16. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Abuse of the Service
  • Non-payment of fees
  • Any reason at our sole discretion

Upon termination, your right to use the Service will immediately cease. You may request a copy of your data before deletion.

17. Modifications to Service and Terms

We reserve the right to modify or discontinue the Service at any time, with or without notice. We may also update these Terms from time to time.

Notice of Changes: For material changes to these Terms, we will provide at least 30 days' advance notice via email to your registered email address or through a prominent notice on the Service before the changes take effect. Non-material changes (such as corrections or clarifications) may take effect immediately upon posting.

Your continued use of the Service after the notice period constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service before the changes take effect.

18. Governing Law and Dispute Resolution

Hireflow is operated from New Zealand. These Terms are governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law principles.

Jurisdiction: Any disputes arising from these Terms or your use of the Service will be subject to the courts of New Zealand, except where mandatory consumer protection laws in your jurisdiction require otherwise.

Alternative Dispute Resolution: Before initiating formal legal proceedings, we encourage you to contact us at legal@tryhireflow.com to attempt to resolve any dispute through good faith negotiation. If a dispute cannot be resolved through negotiation, you may choose to pursue mediation or arbitration in New Zealand, subject to your local consumer protection laws.

Consumer Rights: Nothing in this section limits or excludes your rights as a consumer under mandatory consumer protection laws in your jurisdiction, including but not limited to the New Zealand Consumer Guarantees Act 1993, Australian Consumer Law, UK Consumer Rights Act 2015, EU consumer protection directives, or similar laws in your country. If you are a consumer in the European Union, you may also bring proceedings in the courts of your country of residence.

Class Actions: To the extent permitted by applicable law, you agree that any disputes will be resolved on an individual basis and waive any right to participate in class-action lawsuits, except where such waiver is prohibited by law.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

20. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of war or terrorism, pandemics, government actions, power outages, internet or telecommunications failures, or third-party service provider outages. During such events, our obligations will be suspended for the duration of the force majeure event.

21. Survival

The following sections shall survive termination or expiration of these Terms: Section 8 (User Content and Ownership), Section 10 (AI-Generated Content Disclaimer), Section 11 (Intellectual Property), Section 13 (Disclaimers and Warranties), Section 14 (Limitation of Liability), Section 15 (Indemnification), Section 18 (Governing Law and Dispute Resolution), and any other provisions that by their nature should survive.

22. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Hireflow regarding the Service and supersede all prior agreements.

23. Consumer Rights

Nothing in these Terms excludes or limits any consumer rights that cannot be excluded or limited under the laws of your jurisdiction. If you are a consumer (not a business), you may have additional rights under:

  • New Zealand: Consumer Guarantees Act 1993, Fair Trading Act 1986
  • Australia: Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010)
  • United Kingdom: Consumer Rights Act 2015, Consumer Contracts Regulations 2013
  • European Union: Consumer Rights Directive (2011/83/EU), Unfair Contract Terms Directive (93/13/EEC)
  • United States: State consumer protection laws (varies by state)

These mandatory consumer protection laws may provide you with rights regarding the quality, fitness for purpose, and refunds that cannot be excluded by contract. If any provision of these Terms conflicts with your mandatory consumer rights, those rights will prevail to the extent of the conflict.
